Terms of Service

The plain-language version of what you're agreeing to by using VENS.

These terms cover VENS, an app published by Crema Software LLC ("Crema Software," "we," "us") for iPhone, iPad, Mac, and Apple Watch. By downloading, installing, or using VENS, you agree to these terms. If you don't agree, please don't use the app.

What VENS Is

VENS helps you plan festivals, preserve setlists, and identify live music via Track ID, and syncs your data through your own iCloud account. Some features — Squad, community setlists, the leaderboard — involve sharing information with other VENS users or contributing to a shared community record, as described in our Privacy Policy.

Accounts

VENS doesn't have its own sign-up or password system — it uses whichever iCloud account is signed into your device. You're responsible for whatever activity happens under your iCloud account within VENS, and for keeping that account secure through Apple's own tools.

Subscriptions & Purchases

  • VENS offers auto-renewable subscriptions (Monthly, Yearly) and a one-time Lifetime unlock through Apple's In-App Purchase system.
  • Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to at purchase (subject to any price change Apple requires advance notice for).
  • You can manage or cancel subscriptions any time in your device's Settings → [your name] → Subscriptions — Crema Software has no ability to process refunds or cancellations directly, since Apple handles all billing.
  • Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription during that trial.

Community & Shared Content

Some of what you add to VENS — community setlist contributions, squad status, public festival records — is visible to other users by design, as covered in the Privacy Policy. Don't submit content you don't have the right to share, and don't use community features to harass other users, post anything illegal, or knowingly submit false information (e.g. a fabricated setlist).

Acceptable Use

Use VENS the way it's meant to be used. Specifically, don't:

  • Reverse-engineer, decompile, or attempt to extract the source code of the app, beyond what's permitted by law.
  • Use automated tools (bots, scripts) to interact with VENS's shared community data at a scale beyond normal personal use.
  • Attempt to disrupt, overload, or gain unauthorized access to VENS's backend services or other users' data.
  • Impersonate another person or misrepresent your affiliation with any artist, festival, or organization.

Intellectual Property

VENS itself — its design, code, and branding — belongs to Crema Software LLC. Festival names, artist names, and similar third-party marks referenced in the app belong to their respective owners; VENS is not affiliated with or endorsed by any festival or artist unless explicitly stated.

Third-Party Services

Connecting Apple Music, Spotify, YouTube Music, or optional Gemini scanning is governed by each service's own terms — Crema Software isn't responsible for their availability, content, or how they handle your data once connected or used.

VENS does not share connected music service account data with friends, squads, leaderboards, public festival records, badges, or social stats. Social sharing in VENS is user-directed and limited to the feature you choose to use, such as sharing a playlist link, squad status, challenge, or show-related contribution.

Apple Music & MusicKit

If you grant Apple Music access, VENS uses MusicKit to search the Apple Music catalog, create playlists you request, and add selected tracks to those playlists in your Apple Music library. By using Apple Music features, you also agree to Apple's applicable terms, including the Apple Media Services Terms and Conditions. Apple Music data is also handled by Apple as described in Apple Music & Privacy.

VENS does not use Apple Music data for advertising, tracking, resale, identifying users or devices, social profiling, or any unrelated third-party purpose. You can revoke Apple Music access in your device settings.

Spotify

If you connect Spotify, VENS uses the Spotify Web API to create playlists and add matched tracks only when you request playlist publishing. By using Spotify features, you also agree to Spotify's Terms and Conditions of Use, Privacy Policy, and applicable Spotify developer policies.

VENS does not sell Spotify user data, use Spotify data for advertising or profiling, share Spotify account data into social features, or use Spotify content or Spotify user data to train machine learning or artificial intelligence models. Spotify is a third-party beneficiary of these Terms and our Privacy Policy and is entitled to directly enforce them where applicable under Spotify's developer terms.

You can disconnect Spotify in VENS or revoke VENS's Spotify access at any time from your Spotify account apps page at https://www.spotify.com/account/apps/. If you revoke access, VENS will no longer be able to create or modify Spotify playlists for your account unless you reconnect Spotify.

YouTube Music & Google API Services

If you connect YouTube Music, VENS uses YouTube Data API Services to create private playlists and add matched videos to those playlists only when you request playlist publishing. By using the YouTube Music feature, you also agree to the YouTube Terms of Service, the Google Privacy Policy, and the Google API Services User Data Policy.

VENS does not upload videos, download YouTube videos or audio, sell Google user data, use Google user data for advertising, or share Google/YouTube account data into social features. You are responsible for the playlists created in your YouTube account and for following YouTube's rules when using YouTube services.

You can disconnect YouTube Music in VENS or revoke VENS's access to your Google account at any time from Google Account permissions. If you revoke access, VENS will no longer be able to create or modify YouTube playlists for your account unless you reconnect YouTube Music.

Gemini / Cloud AI Scanning

If you choose the "Advanced & Powerful" scanning mode and provide a Gemini API key, VENS may send selected poster images or pasted lineup/setlist text to Google's Gemini API to extract structured festival or setlist information. If you choose "Fast & Private," VENS uses on-device Apple Vision OCR instead for photo scanning.

Your use of Gemini is subject to Google's applicable Gemini API terms and policies. You should not submit sensitive, confidential, or personal information to Gemini through VENS.

Setlist, Artist & Reference Data Sources

VENS uses third-party public data sources such as public setlist/event references, Last.fm, MusicBrainz, Discogs, Wikipedia/Wikimedia, and limited search fallbacks to help find, verify, enrich, and attribute artist, festival, setlist, venue, genre, and song information. These sources are governed by their own terms, licenses, API rules, attribution requirements, rate limits, and availability.

VENS is not affiliated with or endorsed by any public setlist/event reference source, Last.fm, MusicBrainz, Discogs, Wikimedia, search provider, SeatGeek, Spotify, YouTube, Google, Apple, any artist, any festival, or any venue unless explicitly stated. Third-party data may be incomplete, delayed, inaccurate, community-contributed, changed, rate-limited, or unavailable.

If you save or contribute a festival, setlist, source image, Track ID result, correction, or recap to VENS, you are responsible for making sure you have the right to submit that content and that your contribution is accurate to the best of your knowledge. Do not submit copyrighted photos, private information, fabricated setlists, or other content you do not have permission to share.

Maps, Tickets & External Websites

VENS may open Apple Maps or third-party ticket/search websites such as SeatGeek for convenience. VENS does not sell tickets, broker ticket purchases, process ticket payments, guarantee ticket availability, or control third-party pricing, refunds, delivery, or event policies. Your use of those external websites is governed by their own terms and privacy policies.

Disclaimer of Warranties

VENS is provided "as is." We work to keep festival and artist data accurate, but a lot of it is community-contributed or drawn from third-party sources, and we don't guarantee it's complete or error-free. We don't guarantee the app will be uninterrupted, secure, or free of bugs.

Limitation of Liability

To the fullest extent permitted by law, Crema Software LLC isn't liable for indirect, incidental, or consequential damages arising from your use of VENS — including inaccurate festival/artist data, lost content, or missed shows. Our total liability for any claim relating to VENS is limited to the amount you paid us in the 12 months before the claim, if any.

Termination

You can stop using VENS any time by deleting the app. We may suspend or terminate access for a user who violates these terms, particularly around community content abuse or attempts to disrupt the service.

Changes to These Terms

If these terms change in a material way, we'll update the "Last updated" date above. Continued use of VENS after a change means you accept the updated terms.

Governing Law

These terms are governed by the laws of the United States and the state in which Crema Software LLC is organized, without regard to conflict-of-law principles.
